VanEck’s CEO, Jan van Eck, expressed doubts about the SEC approving spot Ethereum ETFs in May during a CNBC interview on April 9. He anticipates that VanEck’s application for a spot Ethereum ETF, one of the first submitted in the US along with ARK Invest, will likely be rejected.

Both companies are set to receive decisions on their applications on May 23 and May 24, respectively. VanEck explained that the legal process has involved ongoing regulatory feedback for weeks, yet there has been no advancement on their Ethereum ETF applications. This situation has led VanEck and other industry experts to conclude that approval in May is improbable.
